1. Assumption of Risk
I, [The Agreeing Party], understand that participation in cheerleading, tumbling, gymnastics, and other athletic activities at Legends Sports Academy Belmont LLC (LSA) involves inherent risks, including but not limited to:
Falls, collisions, strains, sprains, fractures, concussions, and other injuries.
Exposure to communicable diseases, including but not limited to COVID-19 and airborne illnesses.
Accidents or injuries from training equipment, spotting, or facility use.
Risks associated with travel to and from LSA activities.
I acknowledge that LSA has implemented safety measures but cannot eliminate all risks. By signing this waiver, I voluntarily assume full responsibility for these risks.
2. Release of Liability
On behalf of myself, my child, and all related parties, I waive, release, and forever discharge LSA, its directors, officers, employees, coaches, and agents from any and all claims, liabilities, damages, or losses—including those caused by negligence—arising from participation in LSA activities.
I agree not to file or participate in any lawsuit against LSA for injuries, illnesses, or damages sustained during participation.
I understand that LSA is not responsible for personal property that is lost, stolen, or damaged while on its premises.
3. Medical Authorization
In the event of an emergency, I authorize LSA staff to seek and provide medical attention for my child if I cannot be reached.
I agree that I am fully responsible for all medical expenses incurred.
I confirm that my child is physically fit and has no medical conditions that would prevent safe participation in LSA activities.
If my child has pre-existing medical conditions or allergies, I acknowledge that I am responsible for informing LSA in writing before participation.
4. Indemnification
I agree to indemnify and hold harmless LSA, its directors, officers, employees, and agents from any and all claims, demands, legal actions, and costs arising from or related to my child’s participation in LSA programs.
5. Photo & Media Release
I grant LSA permission to photograph and record my child during activities for promotional, marketing, and educational purposes.
I understand that no compensation will be provided for the use of such media.
If I wish to opt out, I will submit a written request to LSA.
6. Governing Law & Dispute Resolution
This agreement is governed by the laws of North Carolina.
Any disputes shall first be resolved through mediation and, if necessary, binding arbitration under the rules of the American Arbitration Association (AAA).
7. Severability Clause
If any provision of this agreement is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
8. Acknowledgment & Signature
I have read and fully understand this Liability Waiver & Assumption of Risk Policy.
I voluntarily agree to its terms.
I accept all risks associated with participation in LSA activities.
